Proposal Would Allow Permanent HDHP Waiver for Telehealth Services
Senators Steve Daines (R-MT) and Catherine Cortez Masto (D-NV) have introduced S. 763, the Telehealth Expansion Act of 2025. The Act would make permanent the ability of high deductible health plans (HDHPs) to waive the deductible for telehealth services without causing plan participants to lose the ability to contribute to a health savings account (HSA). Representative Jodey Arrington (R-TX) and several co-sponsors have introduced H.R. 1650, a companion bill in the House.
Temporary relief was granted under the Coronavirus Aid, Recovery, and Economic Security (CARES) Act in 2020, and the Consolidated Appropriations Act of 2023 (CAA 2023) further extends relief to December 31, 2024. The provision expired for calendar year plans on December 31, 2024.
