The Internal Revenue Service has issued Notice 2026-33, to provide guidance on qualified long-term care distributions for long-term care insurance premiums pursuant to Section 334 of SECURE 2.0. Congress made the option available for these special retirement plan distributions after December 29, 2025.

The notice provides guidance to providers of certified long-term care insurance relating to the disclosure and reporting requirements, and to plan administrators making, and individuals receiving qualified long-term care distributions. The deadline for a plan sponsor of a defined contribution plan that is not a governmental plan, a section 403(b) plan maintained by a public school, or an applicable collectively bargained plan, to amend its plan to permit qualified long-term care distributions, is December 31, 2027.
