November 4, 2009 – A high-ranking IRS representative with responsibility for guidance for 403(b) plans has reportedly stated that vesting of employer 403(b) plan contributions will be allowed in the IRS prototype program. The draft revenue procedure governing the pending 403(b) plan prototype program, which was issued in April 2009 in Announcement 2009-34, did not include the ability to incorporate vesting in a prototype-based 403(b) plan. The IRS official, speaking at a conference sponsored by the American Society of Pension Professionals and Actuaries (ASPPA), stated that the revenue procedure will be amended prior to being finalized, and vesting of employer contributions will be allowed.
